شروط الخدمةTerms of Service

الاتفاقيه القانونيه بين 5ERP وبينك كمستخدم للمنصة. باستخدامك للخدمة فأنت توافق على هذه الشروط.The legal agreement between 5ERP and you. By using the Service you agree to these terms.

1. القبولAcceptance

بإنشائك حساب على the5erp.com أو استخدامك للخدمة، فإنك تُقرّ بأنك (1) تبلغ من العمر 18 عاماً فأكثر، (2) لديك صلاحيه إلزام نفسك أو الشركه التي تُمثّلها، (3) موافق على هذه الشروط + سياسة الخصوصية.By creating an account at the5erp.com or using the Service, you confirm: (1) you are 18+, (2) you have authority to bind yourself or your company, (3) you agree to these Terms + the Privacy Policy.

2. الخدمةThe Service

5ERP منصة SaaS لإدارة الأعمال تشمل: نظام محاسبه + مخزون + فواتير ضريبيه إماراتيه + POS + كتالوج + ولاء + HR + مساعد ذكاء اصطناعي. الميزات قد تُضاف أو تُعدَّل بمرور الوقت.5ERP is a SaaS platform with: accounting, inventory, UAE VAT invoicing, POS, catalog, loyalty, HR, and an AI assistant. Features may be added or modified over time.

3. الحسابAccount

• أنت مسؤول عن سرية كلمة المرور وكل النشاط على حسابك.You are responsible for password confidentiality and all activity on your account.
• يجب إخطارنا فوراً عند أي وصول غير مصرّح به.Notify us immediately of any unauthorized access.
• المعلومات التي تُقدّمها يجب أن تكون دقيقه وحديثه.Information you provide must be accurate and current.

4. التجربة المجانيةFree trial

كل حساب جديد يحصل على 5 أيام تجربة مجانية بدون بطاقة ائتمان. بانتهاء الفتره يُغلَق الوصول للوظائف حتى تشترك. لا يتم خصم تلقائي.Each new account gets 5 days free trial with no credit card. After the period access is gated until you subscribe. No automatic charge.

5. الاشتراك والدفعSubscription & payment

• الشهري: 500 درهم إماراتي / شهر، تُجدَّد كل 30 يوماً.Monthly: AED 500 / month, renewing every 30 days.
• السنوي: 5,000 درهم إماراتي / سنه (= شهرين مجاناً)، تُجدَّد كل 365 يوماً.Yearly: AED 5,000 / year (= 2 months free), renewing every 365 days.
• الأسعار شامله ضريبة القيمة المضافة (VAT 5%) عند الاقتضاء.Prices include UAE VAT 5% where applicable.
• المدفوعات عبر Ziina (مزوّد مرخّص في الإمارات).Payments via Ziina (UAE-licensed PSP).
• تذكير قبل التجديد بـ 3 أيام عبر الإيميل + إشعار داخل النظام.Renewal reminder sent 3 days before via email + in-app.

6. الإلغاء والاستردادCancellation & refund

يمكنك إلغاء حسابك في أي وقت من الإعدادات. التفاصيل في سياسة الاسترداد.You may cancel at any time from Settings. Details in our Refund Policy.

7. الاستخدام المقبول (AUP)Acceptable Use

توافق على عدم:You agree NOT to:

• استخدام الخدمة لأي نشاط غير قانوني (غسيل أموال، تهرّب ضريبي، تجاره ممنوعه).use the Service for illegal activity (money laundering, tax evasion, prohibited goods).
• محاوله اختراق أو تجاوز قيود الأمان أو الوصول لحسابات الآخرين.attempt to hack, bypass security, or access other tenants' data.
• هندسه عكسيه (reverse-engineering) للكود أو سرقه الـ API keys.reverse-engineer the code or steal API keys.
• إرسال spam أو محتوى مسيء عبر WhatsApp أو الإيميل المُدمَج.send spam or abusive content via the WhatsApp / email integrations.
• استغلال المساعد الذكي لتوليد محتوى مسيء أو ضار.misuse the AI assistant to generate harmful content.

الانتهاك يُؤدّي إلى تعليق الحساب فوراً بدون استرداد.Violation results in immediate suspension without refund.

8. المساعد الذكيAI assistant

المساعد الذكي يستخدم نماذج LLM خارجيه. الردود إرشاديه وقد تحتوي أخطاء. أنت مسؤول عن مراجعة:The AI assistant uses external LLMs. Outputs are advisory and may contain errors. You are responsible for reviewing:

• قيم الفواتير، الضرائب، التقارير قبل تقديمها للحكومه أو العملاء.invoice amounts, taxes, reports before submitting to authorities or customers.
• أي إجراء على البيانات (إنشاء، تعديل، حذف).any data action (create, modify, delete).

9. ملكية البياناتData ownership

• بياناتك ملك لك. يمكنك تصديرها أي وقت بصيغه Excel/CSV.Your data belongs to you. Export anytime in Excel/CSV.
• 5ERP تملك الكود المصدري للمنصه + التصميم + اللوغو.5ERP owns the platform source code + design + logo.
• تمنحنا ترخيصاً غير حصري لاستخدام بياناتك بقدر ما يلزم لتقديم الخدمة فقط.You grant us a non-exclusive license to use your data only as needed to provide the Service.

10. التوافرAvailability

نسعى لـ uptime 99.5% شهرياً. لا نضمن خدمه متواصله — قد تحدث صيانه مجدوله (مع إخطار 24 ساعه مسبقاً) أو أعطال طارئه. لا نتحمّل مسؤولية الخسائر الناتجه عن انقطاع.We target 99.5% monthly uptime. We do not guarantee uninterrupted service — scheduled maintenance (with 24h notice) or emergencies may occur. We are not liable for losses from downtime.

11. التعديلاتChanges

قد نُحدّث الشروط. التغييرات الجوهريه تُعلَن قبل 30 يوماً بإيميل + إشعار داخل النظام. استمرارك في الاستخدام يعني القبول.We may update these Terms. Material changes are notified 30 days in advance via email + in-app. Continued use = acceptance.

12. الإنهاءTermination

• يمكنك إنهاء الاشتراك أي وقت من الإعدادات.You may terminate anytime via Settings.
• يحقّ لنا تعليق/إنهاء الحساب فوراً لو خالفت AUP أو تأخّر دفع > 14 يوماً.We may suspend/terminate immediately for AUP violation or payment overdue > 14 days.
• بعد الإنهاء — لديك 30 يوماً لتصدير بياناتك قبل حذفها (راجع §5 خصوصية).After termination — you have 30 days to export data before deletion (see Privacy §5).

13. المسؤوليهLiability

الخدمة مقدّمه "كما هي" (AS-IS). إلى أقصى حدّ يسمح به القانون:The Service is provided "AS-IS". To the maximum extent permitted by law:

• لا نضمن مطابقتها لغرض معيّن أو خلوّها من الأخطاء.we make no warranty of fitness for a particular purpose or freedom from errors.
• إجمالي مسؤوليتنا في أي 12 شهراً لن يتجاوز المبلغ الذي دفعته لنا خلالها.our total liability in any 12-month period shall not exceed the amount you paid us during that period.
• لا نتحمّل خسائر غير مباشره (أرباح ضائعه، توقف عمل، فقد بيانات).we are not liable for indirect losses (lost profits, business interruption, data loss).

14. القانون الحاكمGoverning law

هذه الشروط تخضع لقوانين دولة الإمارات العربية المتحدة. أي نزاع يُحلّ أمام محاكم دبي المختصّه.These Terms are governed by the laws of the United Arab Emirates. Disputes shall be resolved before the competent courts of Dubai.
